Ebay Criticized for Listing Holocaust Items

Ebay, the online auction giant, recently posted an apology for some items listed on its site that apparently contradicted its terms of use. Someone on the site was apparently trying to sell items related to the Holocaust. When eBay found out about the items, it removed them and offered a public apology to anyone who may have been offended.

I really don’t know why these items were offensive. I totally understand that the Holocaust is a significantly traumatic historical event about which millions of people are sensitive. But the items on eBay were not attempting to make light of Jewish suffering or encourage discrimination or hate against Jews. The items are relics of history. Included in the lot were yellow armbands used to designate Jews during the Holocaust and clothes of concentration camp victims, among other things. These items might be found in museums. Would a museum be profiting off of Jewish persecution if it charged an admission fee to see Holocaust items?

Some Jewish spokespeople argued that such items should not be sold to private parties because they should be “preserved” in museums. That argument doesn’t explain why they shouldn’t be on eBay. The very fact that they were on eBay means they are already owned privately. And listing them on eBay makes them available to museums for preservation. Removing them from eBay, however, does not mean they will be properly preserved.

This is just another example of our extraordinary over-sensitivity. eBay had to do what it did for financial reasons. I can see that. But the items weren’t necessarily in contradiction to its stated terms of use. It disallows items that “glorify hate or promote religious intolerance.” I don’t see that these items necessarily fit that description. One commenter on the situation wrote:

I, personally as a black person, if they had slave items listed on eBay I would be offended, so for Holocaust items I believe they should also be offended and not be sold.

I don’t understand that sentiment. (I barely understand that sentence, actually.) Where would you draw the line? Are you allowed to sell German WWII memorabilia? What about prints of old photographs or drawings depicting Holocaust-era Jews? There really isn’t any end to this. Anything can bring up painful “memories” if set in the right context. But properly dealing with the aftermath and consequences of traumatic events is not the same thing as being shielded from its existence. If “those who do not learn from history are doomed to repeat it,” it seems that historical and physical reminders of humanity’s past missteps are necessary to keep us walking the right direction in the future.

You have repeatedly suggested in the comments that the private property owner should, instead of selling his/her property, they should donate it to a library.

            FWIW, this is the way the mind works of all the control freaks, tyrannies, and dictatorships, they don’t really believe in private property and want to control every minute detail of other people’s lives. If they feel offended, then they believe all should be offended and forced to cow tow to their hurt or injured feelings. Ultimately, they’re arrogant in they think they’re mentally higher than others so therefore, it’s ok to control other people. After all, they’re doing it for all the little people’s own good. Are you trying to say it’s wrong to sell any private property, of historical value, that happens to be from a negative piece of history? Isn’t that stealing from the private property owner? Stealing is clearly wrong. Selling private property, that just so happens to have a historical value to a time period that was horrifying, is not wrong.
      You are perfectly within your right should you have some private property that bothered your conscience to sell to not sell it. However, to dictate or even suggest that the owner is somehow doing something wrong by selling their own property, is wrong. It’s coveting control over that which does not belong to you. Coveting and stealing are both wrong.

  3. Yes, relicts of the Holocaust and slavery can be upsetting to people who personally identify with those traumatic events, but every restriction is a diminishment of liberty and should not be encouraged in America (“land of the free”).

    What’s worse, restrictions like that in the eBay case are open-ended, allowing any feeling of offense by anyone to curtail another person’s liberty. If Muslims regard symbols of Christianity, such as a crucifix, to be offensive, should they be allowed to prevent the public sales of such symbols?

    And it’s hypocritical. I’m personally offended by pictures of Obama, but I doubt that the liberals who are pushing the eBay restrictions would allow me the same prerogative

    • What you’re saying is inaccurate. The restrictions are quite plain, and if an item is questionable you can ask for clarification from Ebay’s staff. We’ earn just over half of our business on Ebay and have sold there for over a decade so you’re obviously not a seller in this marketplace or you’d know you’re talking out your backside.

        • Here’s a link to all the items, but I’ll tell you in general you can’t sell Nazi items (the say skinheads would buy them for racists purposes but I’ve found ways around that with photoshop and hint wording for example) but it’s a fairly extensive list so you just need to read the list and pick out categories where the prohibited items might fall into. After years of this I’ve also cultivated a list of consumer with particular interests that’s let’s me by pass Ebay but it’s tricky stuff and remember it’s not just ebay but you may get away with some items and not others simply because Ebay does rely on snitches (read that as competitors) who will try to get you listing booted so they can sell there’s. The best way around it is setting a price and running a Buy It Now but remember to many hits in a certain time period can get you suspended and booted completely so I’m fairly careful. I made a ton of mistakes in my first year and got booted but then created an LLC and started again to get around the ban.

It’s only been a handful of times over the years I’ve sold anything on ebay, (99 percent buyer), but it’s good to know and understand the policies. I went to the link and then scrolled down to the Offensive Material Policy. http://pages.ebay.com/help/policies/offensive.html I’ve got to say that it’s pretty subjective. These historical artifacts are not something that glorify or promote nazis. They’re just part of history. Down at the bottom of this page they specifically have a Nazi and Nazi-related link but the link just links back to the same page. (it’s like they may have had plans to make a specific page for Nazis, but they haven’t, yet.) Honestly, as a seller, I wouldn’t look at these historical pieces as promoting nazis. But then they’ve written this policy so open that a Mac truck could drive through it.

          • Oh I understand and I have lot of complaints but at the end of the day it’s their site, they’re hired a CEO and they’re a publicly traded company and can do as the dang well please. Since so much of our income is dependent on them I have to put up with a lot. They bend over the kiss a buyers behind even when they’re wrong, sellers cannot leave negatives for buyers anymore, the fee’s have climbed…..Oh I have complaints but in the last 10 years we’ve grossed $537.533.00 on their site and when we couple that with our brick *& mortar and what our private site does ebay’s the biggest chuck of the cash so they’re the best game in town. We also use craigslist, etsy, and a couple of others but the lions share comes in from Ebay so I stay and put up with it. Since they went public and use corporate CEO’s with MBA’s they’ve lost ground but picked some of it up. Just because you have an MBA doesn’t mean you understand how Ebay started as a trading community, these CEO’s have done their damnedest to take the community aspect out and the current CEO call’s sellers like me “Noise” since their are so many that drop ship Chinese garbage and I sell predominately American made antiques and collectibles and some war memorabilia and I just photshop the Nazi symbol off medals and stuff because the collectors know what it should look like and I use phrasing like German WW2 medal with appropriate markings. You don’t see the Nazi logo and I don’t use he word Nazi so I get away with most of it.

These sites have all made choices they feel are best for their business and business model and you don’t HAVE to use them.   4. I totally concur with what you have said. My former wife had a Jewish Hungarian second cousin who was at Auschwitz. because he could speak German he was forced to act as their translator. This fact is what saved his life. I don’t think anyone would accuse him of collaborating with the enemy, simply because he did their bidding.
    I can’t imagine calling a person an anti-Semite simply because they collect Holocaust items. I think such items serve as a constant reminder of what must never happen again.

  6. E-Bay has some relatively fuzzy thought processes. I have a bunch of material that I am selling that references Cuba … in the early 1900’s and … since there is an embargo on recent Cuban materials … everything that mentions the name “Cuba” has been removed.

    I keep wondering if they pull stuff related to Cuba Gooding off too. MAybe they just terminated his contract? Assuming he has one.

  8. The restrictions are a private parties right to place on their domain. END OF STORY, Ebay owns the site Ebay sets the rules. You’d argue it for any other business so I don’t understand the objections to a company deciding what’s best for it’s business.

  11. E-bay is so politically correct they make me sick! I wish there were an alternative to them and I’d drop them like a hot potato! I sell militaria, mostly knives and bayonets. All perfectly legal. But if I take a bayonet for an M-1 Garand rifle, that is OK! But take the identical bayonet, but it fits the M-14 rifle (which we cannot legally own) or an M1A1 semi auto rifle, which we can, and because some chuckle headed numb skull(s) at e-bay says it is an accessory for an “ASSAULT RIFLE” (OH MY!!!) they threatened me with suspension, and pulled the listing!!! Now someone has to explain to me how someone could be offended by that M-6 bayonet??? Or an M-7 bayonet??? (fits the M-16 which many Vietnam Vets carried) You would have to go on there looking for it, it is just not going to “POP UP!!” Same thing with Nazi stuff!!! I don’t like, or collect it, but it is a part of History. The dang Roman’s had probably the most savage Military in History, yet there is no ban on their stuff!! The British Empire had their “MOMENTS TOO!!!” ( just look how many prisoners died on their prison ships in NY Harbor) in India, or Australia or an one of 100 Colonies, but no ban there!!     • Odds are it’s your competitor’s and not Ebay. Happens almost always that a competitor will turn your listing in and say it’s a prohibited item and ebay pulls it. Then you have to call freaking customer service and explain why it’s not and even then you may have to to rewrite the title to make it work or wait until the idiot that turned me in finds somebody else to go after. Trust e it’s not an ebay employee randomly pulling your listings, some body else is turning your listing into them.. They admit they count on members to “Self Police” which means any a-hole with a grudge against you can screw your sales up
